Terms of Service — ParkStayNow

1. Acceptance of Terms & Eligibility

By accessing the Site, creating an account, or completing a reservation, you accept and agree to be bound by these Terms, our Privacy Policy, and our Cancellation Policy, each of which is incorporated into these Terms by reference. If you do not agree, do not use the Service.

You must be at least 18 years old and able to form a legally binding contract to use the Service. By making a reservation you represent that all information you provide is true, accurate, and complete, and that you are booking for yourself or for someone who has authorized you to accept these Terms on their behalf.

2. The Service — ParkStayNow Is a Marketplace Only

ParkStayNow operates an online marketplace that lets you discover, compare, and reserve airport parking and hotel + parking packages offered by independent parking facility and hotel operators (each an “Operator”). We provide reservation and marketing services only. We do not own, operate, manage, control, inspect, or supervise any parking facility or hotel, and we do not provide parking, transportation, shuttle, or lodging services of any kind.

Each Operator is an independent business. Operators are not employees, agents, partners, or joint venturers of ParkStayNow, and ParkStayNow is not an agent of any Operator except for the limited purpose of collecting payment on the Operator’s behalf. The contract for the actual parking or lodging services is formed directly between you and the Operator.

ParkStayNow never takes possession, custody, or control of your vehicle or its contents, and no bailment is created between you and ParkStayNow at any time. When you park at an Operator’s facility, any bailment or license that may arise is solely between you and that Operator.

3. Reservations, Pricing & Payment

Prices, availability, amenities, and facility details displayed on the Site are supplied by or on behalf of Operators and may change until your reservation is confirmed. The total shown at checkout — including any service fee and applicable taxes — is the amount you will be charged. A service fee compensates ParkStayNow for operating the marketplace and is retained by ParkStayNow.

Payments are processed by our third-party payment processor, Stripe. By submitting payment information you authorize us and Stripe to charge your payment method for the full reservation amount. Your payment to ParkStayNow constitutes payment to the Operator for the purpose of securing your reservation.

A reservation is confirmed only when you receive a confirmation code (format PSN-XXXXXX) on the confirmation page or by email. We may cancel and refund any reservation that we reasonably believe is fraudulent, speculative, erroneous (including obvious pricing errors), or made in violation of these Terms.

4. Cancellations & Refunds

Cancellations and refunds are governed by our Cancellation Policy, which is part of these Terms. In summary: cancellations made more than 24 hours before your scheduled parking start time receive a full refund; cancellations within 24 hours of your start time, after your reservation has started, and no-shows are non-refundable. Refunds are issued to your original payment method and typically post within 5–10 business days. Unused time on a reservation is not refundable, regardless of weather, traffic, flight changes or cancellations, or other circumstances.

5. Changes & Overstays

Your reservation covers only the dates and times selected at checkout. If your travel plans change, cancel and rebook subject to the Cancellation Policy. If your vehicle remains at a facility beyond your reserved end time, the Operator may charge you directly for the additional time at its posted rates, and ParkStayNow has no responsibility for those charges.

6. Your Vehicle & Personal Property

You park at your own risk. You are responsible for ensuring your vehicle is legally registered, insured, and in safe operating condition, and for complying with all rules, signage, and instructions posted at the Operator’s facility. Do not leave valuables in your vehicle.

ParkStayNow is not responsible for loss of or damage to your vehicle, its contents, or any personal property, or for personal injury occurring at any facility. Any claim relating to damage, theft, loss, towing, or injury at a facility must be made directly to the Operator of that facility, and you agree to pursue such claims against the Operator and not against ParkStayNow.

7. Hotel + Parking Bundles

When you book a hotel + parking package, the lodging services are provided solely by the hotel Operator. The hotel’s own policies — including check-in/check-out times, identification and payment-card requirements, incidental deposits, occupancy limits, smoking and pet policies — apply to your stay. ParkStayNow is not responsible for the condition of any hotel room, the availability of hotel amenities, or any act or omission of a hotel or its staff.

8. Accounts & Guest Bookings

You may book as a guest or create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. We are not liable for losses arising from unauthorized use of your account where we have not been negligent.

Your confirmation email is sent to the address you provide at checkout — make sure it is accurate. Reservation self-service (lookup, resend, cancellation) is keyed to your confirmation code and that email address.

9. Acceptable Use

You agree not to:

make any speculative, false, or fraudulent reservation, or any reservation in anticipation of demand;
resell, broker, or commercially redistribute reservations without our written consent;
use any robot, spider, scraper, or other automated means to access the Site, or copy, mine, or harvest its content or data;
probe, scan, or test the vulnerability of the Site, breach or circumvent any security or authentication measure, or interfere with the Site’s operation;
impersonate any person or misrepresent your affiliation with any person or entity;
use the Service for any purpose that is unlawful or prohibited by these Terms.

10. Intellectual Property

The Site and all of its content — including text, graphics, logos, designs, software, and the ParkStayNow name and marks — are owned by or licensed to ParkStayNow and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. No other rights are granted. You may not reproduce, modify, distribute, or create derivative works from any part of the Site without our prior written consent.

11. Third-Party Links & Services

The Site may contain links to, or rely on, third-party websites and services (including payment processing and anti-bot verification). We do not control and are not responsible for third-party content, policies, or practices. Your use of third-party services is at your own risk and subject to their terms.

12. Disclaimer of Warranties

THE SITE AND THE SERVICE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT INFORMATION ON THE SITE (INCLUDING OPERATOR DESCRIPTIONS, PHOTOS, PRICES, AND AVAILABILITY) IS ACCURATE, COMPLETE, OR CURRENT. WE MAKE NO WARRANTY OF ANY KIND REGARDING ANY OPERATOR OR THE SERVICES PROVIDED BY ANY OPERATOR. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARKSTAYNOW AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE, ANY RESERVATION, OR ANY ACT OR OMISSION OF ANY OPERATOR — INCLUDING MISSED FLIGHTS, TRAVEL DELAYS, OR SUBSTITUTE TRANSPORTATION OR LODGING COSTS — EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF PARKSTAYNOW FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THROUGH THE SITE FOR THE RESERVATION GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (US $100). SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

14. Indemnification

You agree to defend, indemnify, and hold harmless ParkStayNow and its owners, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to: (a) your use or misuse of the Service; (b) your violation of these Terms or any applicable law; (c) your violation of any third-party right; or (d) your conduct at, or dealings with, any Operator or facility.

15. Release

If you have a dispute with an Operator or any other third party, you release ParkStayNow and its owners, officers, directors, employees, and agents from all claims, demands, and damages of every kind and nature, known and unknown, arising out of or in any way connected with that dispute.

16. Chargebacks & Unauthorized Use

If you believe a charge was made in error or without your authorization, contact us first at Contact support so we can investigate and resolve it. Initiating a payment-card chargeback for a valid, delivered reservation — or one you canceled outside the refund window — is a breach of these Terms; we may cancel the associated reservation, recover amounts owed (including chargeback fees), and suspend your future use of the Service.

17. Dispute Resolution & Binding Arbitration

Please read this section carefully. It requires you to arbitrate disputes with ParkStayNow on an individual basis and limits the manner in which you can seek relief from us.

Informal resolution first. Before filing any claim, you agree to first contact us at Contact support with a written description of your dispute and give us 30 days to resolve it informally. Most concerns can be resolved quickly this way.

Binding arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that is not resolved informally will be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration will be seated in Ohio, though either party may elect to appear by phone or video, and Ohio law and the Federal Arbitration Act govern this provision. Judgment on the award may be entered in any court of competent jurisdiction.

Exceptions. Either party may (a) bring an individual claim in small claims court, or (b) seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property rights.

YOU AND PARKSTAYNOW EACH WAIVE THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. ALL CLAIMS MUST BE BROUGHT IN THE PARTIES’ INDIVIDUAL CAPACITY, AND THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON’S CLAIMS.

30-day opt-out. You may opt out of this arbitration provision by sending us written notice via Contact support (include your name and the email used for your booking or account) within 30 days of first accepting these Terms. If any part of this Section 17 is found unenforceable, the remainder remains in effect, except that if the class action waiver is found unenforceable, this entire Section 17 is void.

18. Governing Law & Venue

These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-law principles. For any matter not subject to arbitration under Section 17, you and ParkStayNow consent to the exclusive jurisdiction and venue of the state and federal courts located in Delaware County, Ohio.

19. Modifications to These Terms

We may update these Terms from time to time. The current version, with its effective date, will always be posted on this page. Material changes apply prospectively. Your continued use of the Service after updated Terms are posted constitutes acceptance of the updated Terms; reservations are governed by the Terms in effect when the reservation was made.

20. Suspension & Termination

We may suspend or terminate your account or your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraud or abuse, or created risk or possible legal exposure for us, our users, or Operators. Sections that by their nature should survive termination (including Sections 10 and 12–18) survive.

21. Force Majeure

ParkStayNow is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, severe weather, epidemics, labor disputes, utility or internet failures, acts of government, or acts or omissions of Operators or other third parties.

22. General

If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions remain in full force. These Terms, together with the Privacy Policy and Cancellation Policy, are the entire agreement between you and ParkStayNow regarding the Service and supersede all prior agreements. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Our failure to enforce any provision is not a waiver.
